Fraud

By completing an order with Murphy Furniture Clearance or by creating a user account you confirm that the information provided by you is true and correct and you also agree to abide by the Terms and Conditions of use of this Site. Murphy Furniture Clearance reserve the right to cancel a transaction if we determine that (a) false or misleading information has been provided; (b) the Terms & Conditions of use have been violated in any way; or (c) other abuses of use have been determined by Murphy Furniture Clearance in its sole discretion. Murphy Furniture Clearance reserves the right to refuse any future dealings with this customer.

Murphy Furniture Clearance reserves the right in our sole discretion to edit, delete or modify any part of our Site, including but not limited to this Agreement, without further notice to users of the Site.

You, the customer, agree to indemnify, defend and hold us and our partners, solicitors, staff and affiliates (collectively, “Affiliated Parties”) harmless from any liability, loss, claim and expense, including reasonable attorney’s fees, related to your violation of this Agreement or use of the Site.

Although every care is taken by Murphy Furniture Clearance to ensure that the information on this Site is correct all content to include product specifications, prices and availability are subject to change without notice. Murphy Furniture Clearance does not warrant that our Site or any function or material within it is fault or error free. As much as we try to avoid it, errors do happen. Murphy Furniture Clearance reserves the right to cancel your order at any time up to the point where we send you the product(s) in question. We will then issue you with a refund of any payment made. Please note that although products and prices are listed on our Site it is not an offer to sell and should not be interpreted as a contract, implied or otherwise.

Definition of Murphy Furniture Clearance as it relates to products online, and in store 

Murphy Furniture Clearance is made up of the following:

  1. End of catalogue stock
  2. Clearance stock
  3. Surplus end of range stock
  4. Soiled or slightly damaged stock

At Murphy Furniture Clearance all of our products are sold as seen.

Payments

By purchasing a product on our site you represent and warrant that (a) any and all payment information supplied by you is true, correct and complete to include payments made by, but not limited to, credit and debit cards, PayPal accounts etc.; (b) that any charges incurred by you, will be honoured by your credit card/bank; and (c) you will pay charges incurred i.e. applicable taxes.

Our contract once you have ordered

Once you have submitted an order you will be given a unique Murphy Furniture Clearance Code (Product Code) and details of the products (and/or services) you have ordered. You will then receive an email headed ‘Order Acknowledgement’ recognising receipt of your order. We will then send a further email headed ‘Order Confirmation’ and this is when our contract with you begins. If we have to cancel all or part of your order for any reason, we will email you to let you know.

Pre-Assembled Goods

All our products are pre-assembled. Pre-assembled goods are sold for the purposes of display only. Murphy Furniture Clearance recommends to customers that the assembly of the goods is fully inspected by a professional and appropriate adjustments are made in accordance with usage. Murphy Furniture Clearance also recommends that all furniture with moving parts are securely fixed to a wall.

Delivery/Collection of Goods

As noted in our Delivery T & Cs, Murphy Furniture Clearance does not operate a delivery or assembly service. Information on local Courier Services are available to all customers should they choose this option.


Murphy Furniture Clearance does not provide a delivery or assembly service and we will have no liability to you for any failure or delay in collection or third party delivery of goods or any damage or defect in goods delivered or assembled which is caused by a third party or by any event or circumstance which is beyond our reasonable control. Murphy Furniture Clearance is not be liable to you for any indirect or consequential loss or damage arising out of transport or assembly of goods. This does not affect your statutory rights as a consumer. Please note that goods cannot be collected on Sundays or Bank Holidays. A copy of the sales docket will be provided for the delivery driver. By allowing our employees or any representative of a third party company onto your premises the customer is accepting full responsibility without restriction for any loss or damage to their premises or their person. Specifically it is at your own risk that you permit any third party access to your property.

Returns Policy

Please examine all items carefully as all products are sold as seen. All products must be returned complete, unused, packaged and in the condition that they left Murphy Furniture Clearance. If you cancel your order we will refund all monies less 20% restocking fee within 1-5 working days. Murphy Furniture Clearance is not liable for any costs arising from the refund. Mattresses which have been removed from their packaging cannot be returned.

Damaged/Defective Goods

Insofar as is permitted by law, our only liability to you under these terms and conditions will be, at our sole discretion, to replace or repair any goods which are of a defective state and/or are not fit for the purpose in which they are intended, or to refund to you any sums actually paid by you for the goods in question. All goods are sold as seen. We recommend that you thoroughly inspect all products in person prior to sale. We will not be liable to you for any indirect or consequential loss or damage arising out of transport of goods. We do not provide a delivery service and we will have no liability to you for any failure or delay in collection or third party delivery of goods or any damage or defect in goods delivered which is caused by a third party or by any event or circumstance which is beyond our reasonable control. This does not affect your statutory rights as a consumer.

Murphy Furniture Clearance reserves the right to contact a customer via email or phone to verify the accuracy of account information (including address/contact details) that are required to provide information requested by a customer of our website.

Cancellations

You can amend or cancel your order up to time of dispatch. However, if the order has been dispatched you must then return the product to us (unopened and undamaged) within 6 working days and we will arrange a refund. If you cancel your order we will refund all monies within 1-5 working days. Murphy Furniture Clearance is not liable for any costs arising from the refund.

Items not in stock

In the event that you have ordered and paid for an item that is out of stock, our Customer Service Department will contact you within 24 hours to discuss how to proceed. At this point we can either recommend a similar product, or we will refund all monies within 1-5 working days. Murphy Furniture Clearance is not liable for any costs arising from the refund.
